Con la decisione in esame la Corte, soffermandosi per la prima volta sulla questione, ha affermato che ai fini della configurabilità dell’aggravante prevista dall’art. 600-quater, comma secondo, cod. pen. per il delitto di detenzione di materiale pedopornografico (cosiddetta “ingente quantità”), la valutazione del carattere, ingente o meno, del materiale deve essere condotta con riferimento non solo al numero dei supporti, dato di per sé indiziante, ma anche al numero di immagini, da considerare come obiettiva unità di misura, che ciascuno di essi contiene. (Nella fattispecie la Corte ha ravvisato l’ingente quantità nella detenzione di 175 DVD contenenti numerosi files pedopornografici). (cortecassazione.it).

Le Conseil constitutionnel a été saisi le 27 juin 2011 par la Cour de cassation, dans les conditions prévues à l'article 61-1 de la Constitution, d'une question prioritaire de constitutionnalité posée par M. Antoine J. Cette question était relative à la conformité aux droits et libertés que la Constitution garantit de l'article 93-3 de la loi du 29 juillet 1982 sur la communication audiovisuelle. 

Cet article 93-3 est relatif au régime de responsabilité pénale des divers acteurs de la communication par voie électronique, c'est-à-dire, d'une part, de la communication audiovisuelle et, d'autre part, de la communication au public en ligne (internet). Dans ce système de responsabilité en « cascade », est d'abord mis en cause le directeur de la publication, à défaut, l'auteur du message et, à défaut de l'auteur, le « producteur ».

The Court, having had regard to the important role the Internet played for media activities generally, and for the exercise of the freedom of expression, found that the absence of legal regulation allowing journalists to use information obtained from the Internet without fear of being sanctioned, was an obstacle to the press exercising their vital function of a “public watchdog”.

In addition, under Ukrainian law, journalists might be exempt from the payment of compensation if they had acted in good faith, had checked the information and had not disseminated the untrue information intentionally. The applicants had raised all these arguments in their defence yet it had been ignored by the national courts.

The Court concluded that, in the absence of clarity in domestic law in respect of journalists using information obtained from the Internet, the applicants could not have foreseen the consequences of their action. Therefore, the Convention requirement that any limitation to freedom of expression had to have a basis in law, which was clear, accessible and foreseeable, was not met.
