Il VOIP (Voice Over IP) sta creando qualche grattacapo a tutti i soggetti che quotidianamente combattono la criminalità organizzata. E' noto che Skype utilizzando un protocollo crittato di comunicazione di fatto rende impossibile decifrare le conversazioni che vengono effettuate tramite questo software. Con un'iniziativa che segue di pari passo quella annunciata dal Ministero degli Interni, Eurojust, l'unità di cooperazione giudiziaria dell'Unione europea, ha a questo proposito avviato un'indagine formale atta a verificare quali siano le possibilità tecniche e giuridiche per poter implementare un meccanismo di intercettazione simile a quello in uso per i telefonini tradizionali, con buona pace della privacy di tutti coloro che dietro le conversazioni effettuate tramite Skype ritengono di essere al sicuro da orecchie indiscrete. L'agenzia Eurojust garantisce che la privacy verrà tuttavia garantita e tutelata mentre Skype ha comunicato da parte sua che vi sono tutte le intenzioni per porre in essere una fattiva collaborazione.

Il Parlamento europeo, prendendo atto dei numerosi vantaggi che lo strumento del commercio elettronico implica per i consumatori e per le PMI,   chiede che vengano poste in essere misure per aumentare la fiducia in tale strumento alla luce delle truffe che lo penalizzano.Le truffe on line infatti così come altri fenomeni patologici concenrneti il commercio elettronico non vanno d'altra parte attribuiti alla natura del mezzo, ma devono essere considerati "manifestazioni di attività commerciali illecite già presenti nel mondo fisico".

A questo fine il parlamento si auspica che la Commissione si attivi per emanare tutti gli atti normativi necessari affinché lo strumento trovi la più ampia diffusione e, ravvisando l'esigenza di "organizzare campagne di informazione e istruzione al fine di sensibilizzare maggiormente i consumatori sui loro diritti allo scopo di rafforzare la loro fiducia nel commercio online", invita sempre la Commissione a pubblicare sul suo sito web informazioni sui diritti dei consumatori in materia di commercio internazionale su internet, incentrandosi in particolare sulle questioni contrattuali, la protezione dei consumatori contro le pratiche commerciali sleali, la vita privata e i diritti d'autore.

Il prossimo 26 febbraio la Commissione lancerà una cosultazione pubblica per la revisione della normativa sul commercio elettronico al momento disciplinata dalla direttiva 2000/31/EC . L'intento è quello di riaffrontare tutta la disciplina sulla protezione del diritto d'autore online alla luce delle forti resistenze a suo tempo opposte dalle compagnie di telecomunicazione e da tutti gli ISP. In effetti i problemi manifestatasi in questi anni evidenziano come ogni nazione abbia una propria visione sulla responsabilità degli ISP, a volte ritenendoli responsabili a volte invece deresponsabilizzandoli in toto. Questi dati hanno portato alla luce tutte le difficoltà applicative della direttiva sopra richiamata.

• La France est le premier pays qui accueille cette formation européenne pionnière destinées aux juges, procureurs et avocats pour combattre la cyberdélinquance.

Paris, 21 janvier 2008.- L'Ecole Nationale de la Magistrature et Cybex, le premier cabinet espagnol en investigations numériques légales, lancent le 9 février prochain le premier séminaire de formation ECCE sur la cybercriminalité et les preuves électroniques, cofinancé par la commission européenne, par le biais de la Direction Générale Justice, Liberté et Sécurité.



Le projet ECCE sera mis en œuvre lors de séminaires de formation dans 14 pays au total (11 pays européens et 3 pays latino-américains) entre février 2009 et novembre 2010. Le premier séminaire ECCE sera célébré dans les locaux parisiens de l'Ecole Nationale de la Magistrature. Un groupe d'experts nationaux et internationaux sera chargé de cette formation élémentaire, théorique et pratique, qui durera 4 jours à temps complet.



L'objectif principal du programme ECCE est de fournir aux professionnels du droit, juges, procureurs et avocats européens et latino-américains, tout à la fois la capacité théorique et pratique et les connaissances légales et techniques dans le domaine de la lutte contre la cybercriminalité et la preuve électronique. A partir d'une analyse commune sur la cybercriminalité, l'informatique légale et la preuve électronique, la formation abordera le cadre juridique national et international relatif à ces problématiques ainsi que les défis auxquels les Etats doivent faire face dans ce contexte.



Myriam Quemener, magistrat depuis 1986 et actuellement Substitut général au service criminel de la Cour d'appel de Versailles sera l'experte nationale chargée de la formation des participants à l'analyse de la législation et des instruments procéduraux en France. Auteure de plusieurs ouvrages relatifs à la cybercriminalité, son expérience, notamment en tant que sous-directrice à la Direction des Affaires criminelles et des Grâces à la Chancellerie en fait une grande spécialiste de la réalité et des enjeux de la cybercriminalité en France.



A la fin du séminaire de formation, les participants ayant passé avec succès l'examen d'évaluation finale recevront le premier Certificat Européen sur la Cybercriminalité et la Preuve électronique, attestant l'acquisition de connaissances élémentaires légales, techniques, théoriques et pratiques sur les questions liées à la preuve électronique et la cybercriminalité.

Le Certificat Européen sur la Cybercriminalité et la Preuve Electronique (ECCE) est un projet européen cofinancé par Cybex et la Commission européenne, dont l'objectif est de fournir aux juges, procureurs et avocats européens et latino-américains une formation sur la cybercriminalité et la preuve électronique. Ce programme innovateur est le résultat de la collaboration d'un groupe pluridisciplinaire d'experts internationaux. Les séminaires de formation seront mis en œuvre grâce à l'association de 24 institutions partenaires et auront lieu dans 11 pays européens et 3 pays latino-américains jusqu'en novembre 2010. Parallèlement, la première Bibliothèque Electronique sur la cybercriminalité, l'informatique légale et la preuve électronique sera implantée dans le cadre du projet ECCE.

Madrid, 21 January 2008. - On 9 February 2009, Cybex, leading firm in the investigation of economic and financial fraud in Spain, will launch the European Certificate on Cybercrime and Electronic Evidence (ECCE) in France. The ECCE is co-financed by the European Commission through its Directorate General for Justice, Freedom and Security.

This seminar is the first in a series of ECCE courses that will be held in 14 countries (11 in Europe and 3 in America) starting next February until November 2010. The seminar will take place at the French National School for the Judiciary, the partner institution in this country. National and international experts will teach the Basic course, which will combine theory and practice, over four days, full time.

The main aim of the European ECCE project is to provide judges, lawyers and prosecutors in Europe and South America with the necessary technical skills - in a legal framework - on the fight against cybercrime and electronic evidence. The course will start out by analyzing what cybercrime, computer forensics and electronic evidence are, and it will also deepen participants' knowledge of international legislation on this issue and the challenges that nations face in their fight against cybercrime. Mrs. Fredesvinda Insa, European ECCE project director, is among the international speakers that will teach in the course.

Mrs. Myriam Quemener, judge, and currently deputy prosecutor at the Versailles court of appeals, is the national expert that will speak about the situation of legislation and legal instruments on the subject in France. Her experience at the French Ministry of Justice regarding the implementation of crime policies, and as a deputy prosecutor at the Supreme Court (Tribunal de Grande Instance), give her a deep understanding of the reality of cybercrime in her country.

The course is expected to have at least 75 participants: legal professionals (judges, prosecutors and lawyers) who are interested in learning the basics on cybercrime, computer forensics and electronic evidence. At the end of the course, after passing the relevant theoretical and practical tests, participants will receive the first European certificate that vouches for holders' technical knowledge of these issues.


About the ECCE

The European Certificate on Cybercrime and Electronic Evidence (ECCE) is a European project co-financed by the European Commission, which aims to provide judges, lawyers and prosecutors from Europe and South America with the necessary technical knowledge on cybercrime and electronic evidence. It has been developed by a multidisciplinary team of researchers and collaborators from the public and private sectors. The training seminars are taking place thanks to the 24 partner institutions, and will be taught in 11 European and 3 American countries until November 2010. ECCE involves the implementation of the first European e-Library on Cybercrime and Electronic Evidence, which comprises literature, case law and legislation on the subject.

One year after the entry into force of a new EU Directive meant to liberalise TV rules and remove outdated and bureaucratic restrictions on the provision of digital TV over the internet, video on demand and mobile TV in Europe, EU Member States have made little progress in adapting national rules. Only Romania has comprehensively implemented the new EU audiovisual media rules that entered into force on 19 December 2007 (IP/07/1809). The EU's Audiovisual Media Services Directive, adopted by the European Parliament and the EU Council of Ministers on a proposal from the Commission (IP/05/1573) rebooted the old EU rules on traditional TV broadcasting for the digital age and its new generation of TV-like services. The other 26 Member States are currently putting the modernised rules for Europe's audiovisual industry into national law. They have until December 2009. By then the EU should have a single market for all audiovisual media services, providing legal certainty for businesses and more diverse and quality programming for viewers.

EU Competition Commissioner Neelie Kroes and Minister Presidents Kurt Beck (Rheinland-Pfalz) and Günther H. Oettinger (Baden-Württemberg) welcomed today's signature of Germany's 12^th inter-State Treaty on broadcasting. The European Commission has approved under EC Treaty state aid rules a €104 million Italian tax incentive scheme for film production until 31 December 2010. The Commission found that the scheme was compatible with the cultural derogation of the EC Treaty, in line with the Cinema Communication rules concerning aid to film production (see IP/01/1326).

The European Commission has taken a decisive step towards the promotion of competitive Mobile TV services in the EU. It has published a set of guidelines for the authorisation of Mobile TV to accelerate roll-out of the service across Europe. Mobile TV revenues worldwide are expected to reach more than €7.8 billion in 2013. The commercial services launched before summer 2008 in some European countries show that there is an increasing consumer demand: in the Netherlands alone, 10 000 users had already subscribed to the service at the beginning of autumn. Authorisations from Member States for Mobile TV services are needed before any commercial launches by operators. Along with the addition of the DVB-H standard to the EU list of official standards in March 2008 (IP/08/451), these guidelines underline the Commission's strong commitment to the promotion of new services for European consumers.
